An exception may be when the driver of the car in the through lane does not obey a sign to stop or yeild to traffic granting right of way to vehicles that are exiting from the parking lanes.
Pulling Into And Out Of Parking Spots
Sometimes accidents happen when a pair of vehicles are reversing out from spots on the opposing sides of an identical parking lane. In this case, fault can be difficult to ascertain as both drivers have the obligation to ensure it is reasonable safe to back into the lane of traffic before they commence the manouver. When one of the vehicles has commenced backing up, the other driver should take reasonable levels of care to make sure they are observing the other vehicle. When the driver does not do this, they may be at fault.
